This is a summary in plain language of our full Terms and Conditions. The complete legal agreement is provided and signed at time of booking. Questions? Just reach out — happy to walk you through anything.

Effective Terms

These Terms and Conditions are between Sun of a Beach Travel LLC ("Agency," "our," "us," "we") and you ("you," "your," "Traveler"). These Terms become effective upon your written, digital, or electronic signature, or your delivery of payment authorization to us, and terminate upon completion of your Trip (or earlier in writing). These Terms may change at any time without prior notice.

Definitions

Booking means a reservation made by Agency regarding your Trip. Supplier means a party who provides Travel Services to Travelers. Traveler means you and each traveler on the same Booking. Travel Services means travel products and services provided by Suppliers, including air, land, or water transportation, lodging, auto rentals, tours, excursions, entertainment, food and drink, and similar products. Trip means the composite of all Travel Services for which Agency makes Bookings. Trip Plan means the documentation we provide with details and pricing for your Trip.

Traveler Responsibilities

You agree to: carefully read and understand these Terms, your Trip Plan, and all correspondence regarding your Trip; contact us with enough lead time to secure availability and avoid late-booking fees or fare increases; confirm written acceptance of your Trip Plan; make all deposits and payments per the schedule in your Trip Plan; stay aware of U.S. government travel advisories; and comply fully with these Terms. You confirm you are 18 or older and have authority to accept these Terms on behalf of all Travelers on your Booking who reside in your household.

Suppliers

Suppliers (cruise lines, hotels, airlines, tour operators, etc.) are independent of Agency and not our employees, agents, or affiliates. Agency is not responsible for a Supplier's breach of contract, negligence, or errors that result in price changes, delays, damage, loss, or injury. Suppliers operate under their own terms — you are responsible for reading and complying with them, including payment deadlines and usage restrictions. Violating Supplier terms may result in denied services, cancellation, or forfeiture of amounts paid. If a Supplier goes bankrupt, Agency has no obligation or ability to provide refunds.

Travel Risk & Insurance

You understand and accept the inherent risks of travel. We strongly recommend comprehensive travel insurance for every Traveler. If you decline coverage, you assume all financial responsibility for cancellations, interruptions, baggage loss, medical costs, accidents, and emergencies. Insurance policies may exclude pre-existing conditions, pandemic-related interruptions, and certain risk activities/locations — review your policy carefully.

Personal Information

Booking Travel Services requires sharing personal information (birth dates, passport numbers, travel dates, payment details, etc.) with Agency, Suppliers, and third-party platforms. Agency has no liability for how third parties handle or protect this information. You authorize Agency to retain your information as needed for Bookings and reasonable business/legal purposes afterward.

Pricing & Payment

Quoted prices reflect only what's itemized in your Trip Plan — taxes, fees, gratuities, excursions, insurance, and personal charges are typically separate unless stated otherwise. All prices are subject to change until full payment is received. Late or missed payments may result in Supplier fees, cancellation of your Booking, and forfeiture of prior deposits under Supplier terms — Agency is not responsible for consequences of late or non-payment. By submitting a card, you authorize us to charge it per your Trip Plan's schedule and confirm you're an authorized user.

Chargebacks

You agree not to initiate a credit/debit card chargeback for any reason (delays, cancellations, Supplier issues, force majeure, etc.) except in cases of fraud — and even then, you agree to first contact us in writing to allow time to resolve the issue directly. Improper chargebacks may result in you owing Agency for related fees and legal costs.

Changes, Cancellations & Refunds

Refunds and change/cancellation policies are set by each Supplier, not Agency — many Supplier deposits and payments are non-refundable. Any refund or adjustment request must be submitted to Agency in writing with full documentation. Failure to show up for a Booking ("no show") may result in penalties up to the full cost of travel.

Air Travel & Accommodations

Airline tickets are often non-refundable and non-transferable once purchased; name changes are typically treated as cancellations. Seat assignments, baggage, and amenities are subject to airline/hotel policy and availability and are not guaranteed by Agency. Agency is not responsible for schedule changes, delays, cancellations, or amenity availability caused by Suppliers.

Documents: Passports, Visas & ID

You are solely responsible for determining and obtaining all documents needed for your itinerary — passports, visas, and medical documentation — and ensuring they're current. U.S. citizens traveling internationally need a passport valid at least 6 months beyond your return date. No refund will be issued for issues caused by missing or invalid documentation.

Special Needs, Food Allergies & Health

If you have disabilities, special needs, or food allergies, please tell Agency in advance of booking so we can make reasonable arrangements — though Agency cannot guarantee Supplier accommodation. If you become ill or injured during a Trip, you are responsible for your own care, costs, and any resulting travel changes.

Assumption of Risk

You assume all risk, cost, and liability for any activity that carries inherent risk of harm, damage, or loss ("Risk Activity") — including excursions, adventure activities, or travel to destinations that carry elevated risk. You release Agency from any related claims.

Limitation of Liability

Agency arranges Travel Services but does not control Suppliers. We are not liable for any damage, loss, injury, delay, or other harm caused by a Supplier, Traveler, or third party. If any liability is found against Agency despite these Terms, it is limited strictly to the total commission Agency collected on your Booking.

Indemnity

You agree to indemnify and hold Agency harmless from claims, damages, and costs (including attorney's fees) arising from your breach of these Terms or your own acts or omissions.

Force Majeure

Agency is not liable for delays or non-performance caused by events beyond our reasonable control — weather, natural disasters, war, terrorism, strikes, pandemics, or government action.

Governing Law & Disputes

These Terms are governed by the laws of Florida. Disputes will first be addressed through direct, informal discussion. If unresolved within 60 days, any claim will be handled exclusively in state or federal courts in Polk County, Florida.
